Analogía e interpretación extensiva: una
reflexión (empírica) sobre sus confines

RESUMEN
En el presente trabajo el autor defiende la distinción, no aceptada por
todos, entre interpretación extensiva y analogía. Ambas figuras conllevan la
expansión de la norma, pero en la interpretación extensiva la norma se expan-
de a otro caso perteneciente a la misma materia o institución que regula y que
presenta identidad de razón con el caso que la norma contempla. En la analo-
gía, en cambio, la norma se aplica a una materia o institución diversa pero
semejante, de la que en ella expresamente se regula. Viene a ser una interpre-
tación extensiva máxima o superlativa, lo que justifica que sus límites (ex
art. 4.2 CC) sean mayores que los de la interpretación puramente extensiva.

ABSTRACT
In this article the author defends the not widely accepted distinction
between what is known as extensive interpretation of legal rules and analogy.
He argues that both processes expand the legal rule but while in the first case
this expansion applies to a case that belongs to the same legal institution and
shares a common reasoning with the original rule that is to be expanded by this
interpretation; in the second, this is, by using analogy, the legal rule is applied
to a similar but different institution (hence the strict limits ex art 4.2 CC).
