"543.Where possible within the prevailing legal system, the resources of the subsoil of indigenous land also must be regarded as the exclusive property of indigenous communities. Where this is rendered impossible by the fact that the deposits in the subsoil are the preserve of the State, the state must, insofar as the resources existing on indigenous lands are concerned, allow full participation by indigenous communities in respect of: the granting of exploration and exploitation licenses; the profits generated by such operations: the procedures for determining damage caused and compensation payable to indigenous communities as a result of the exploitation of the resources of the subsoil of indigenous land and in the consideration of all consequences of such exploration and exploitation activities.
