El artículo analiza la creciente aplicación de la prohibición de discriminación arbitraria a las relaciones entre privados. Luego de discutir los fundamentos y justificaciones normativas de dicho fenómeno, se problematiza la determinación del contenido de las obligaciones de los privados en materia de no discriminación, así como las categorizaciones y justificaciones que permitirían distinguir la discriminación entre privados que debe ser prohibida.

The article analyzes the increasing application of the arbitrary discrimination prohibition within the relationships of the private sector. After discussing about the normative grounds and reasons for said phenomenon, both the issue of determining the content of the obligations of the private sector regarding non-discrimination as well as the categorizations and reasons that allow differentiating discrimination within the private sector, which shall be forbidden, will be discussed.
